Pre Mediation

It is strongly suggested that the mediator be furnished with all documents and information regarding the case before the initial session. At the mediation session, mediator will meet jointly with all parties and fully explain the process and answer questions. The mediator may then want to meet with each side privately. All information furnished to the mediator is CONFIDENTIAL and cannot be made known to the court or any other person. The goal is for each side to analyze their position and with the assistance of the mediator (facilitator) reach a settlement.

If a case is cancelled 1-2 days from the original mediation date, 100% of the fees will be assessed against the party causing the cancellation and are non-refundable, unless the time assigned can be rescheduled with another matter.  If a case is cancelled 3-5 days from the original mediation date, 50% of the fees will be assessed against the party causing the cancellation.

If a mediation is suspended or recessed after the mediation has begun, none of the fees are refundable.  If a suspended/recessed mediation is rescheduled within 6 (six) months’ time, no additional fee will be assessed.  If a suspended/recessed mediation is rescheduled after 6 (six) months of the original mediation date, new mediation fees will be assessed at 100%. TAMS reserves the right to cancel a scheduled mediation if any portion of the fees are not paid prior to or at the time of the mediation.
